시장점유율 35% (Market Share) 얘기

흥미 별로 없을 얘기!
Canadian Grocer 잡지에 나온 기사 보니...

어느 업체의 그 지역 market share 가 35% 가 넘으면 Competition Bureau 에서 시정명령을 내린다 한다.
(몰랐던 사실!)

Macs 가 최근 ESSO Gas station (with On the Run Convenience) 279개를 모두 구입 인수 했는데...

그 중 2개의 주유소가 그 소재 지역에서 market share 가 35% 이상이 된다며...

그 2개의 주유소를 맥스는 매각처분 하라 요구...맥스에선 팔아버리겠다 했다.

그 중 1개는 Calrlton Place ON 에 있는 Macs 이다.

그런데 위 기사에 나온 Macs in Carleton Place, ON 을 구글지도에서 보니,
Carleton Place, ON 동네에는 모두 5개의 Gas Station 이 있다.

거기엔 ESSO 와 Macs 가 있어
Macs 가 ESSO 를 구입해서 한 업체가 되니....5개 주유소 중 2개가 같은 회사 소유가 됐다.
Market Share (시장 점유율)가 2/5 X 100= 40%

그래서 Competition Bureau 에서 개입해서 Macs 에게 둘 중 1개를 매각해야만 된다 권유!
Macs 는 그리 하기로 약속!!!
(사실은 그 동네 경쟁업체 주유소에서 공정거래국에 불평 제소 했을 게 분명! File a Complaint)

그런데, Carleton Place 는 Ottawa 다운타운에서 서쪽으로 약 50키로 떨어진
인구 10,000명 쯤 되는 타운(Town of Carleton Place) 이다.  

이 35% Market Share 관련 규정은 Price Maintenance (Section 76 of the Competition Act)에 있으며,

Given that the Act is concerned with firms competitive market behaviour, ... of more than 35 percent for private corporations and of more than 2 percent for public....

2.3.1 Market Share
When investigating allegations of abuse of dominance, the Bureaus general approach is as follows:

A market share of less than 35 percent will generally not prompt further examination.
A market share between 35 and 50 percent will generally only prompt further examination if it appears the firm is likely to increase its market share through the alleged anti?competitive conduct within a reasonable period of time.
A market share of 50 percent or more will generally prompt further examination.
In the case of a group of firms alleged to be jointly dominant, a combined market share equal to or exceeding 65 percent will generally prompt further examination.
